Laborers Role Orientation In Labor Law

Experts and scholars appeal to amend and perfect labor law that is executed for ten years. Lots of regulations of labor law got behind with development of era, which have many problems. The most important problems is the adjusting range of labor law, namely orientation of laborers and employing danweis in labor law. Orientation of laborers closely associates with national conditions of China and economic development. For ten years'economic development and being member of WTO, Chinese law links up with world law to a considerable degree. Labor law of our country is slow. When we constituted labor law, the theories of labor legislation were inadequate. Perfect labor law depends on the theoretical researches of labor jurisprudence. Our labor legislation pays attention to legislative policy and legislative technique, but ignores elementary theories of labor law; It pays attention to impendence and practicability, but ignores scientificaalness and preciseness. In particular, we do not lucubrate the elementary theory problems, such as the labor law difference between the condition of planned economy and that of market economy, the notions of laborer, labor relationship and employing danwei in labor law.
