Before the industrial civilization, human was also unlikely to cause significant influence on nature because of the low level of productivity and human was full of boundless reverence to nature. Essentially human civilization was still the survival civilization and the internal contradiction of human society was the principle one at that stage. With the development of science and technology, mankind entered the era of industrial civilization. There was also nature's revenge when some boasted the ability of transforming natural and conquest of nature. However, essentially speaking, the contradiction of people with natural is the contradiction of human internal. It is the misconduct of part of human existence undermines the overall interests of humanity. In order to seek their own development, the certain countries or the certain regions ignore external non-economic problems. Environmental law is intended to regulate the misconduct which is harm to human survival and development. Through the distribution of rights and obligations, environmental laws adjust environmental benefits. Environmental right is the most important core issue of environmental laws.After the concept of environmental right was advanced, whether in legislative practice or legislation theoretical research, remarkable progress have been made. In the legislative practice, the international and regional treaties of environmental rights have emerged. At the same time, States attaches great importance to the role of constitutional and law in the course of protection of environmental rights. However, in some countries based on economic development priorities, constitutions provide little environmental rights. In addition, because of the uncertainty of environmental concept, some countries provide the environmental rights in vague language although provide. In China, environmental rights have not been provided in the Constitution. It is apparent that environmental obligations have priority in specific legal norms.
