On The Enactment Of Civil Code And The Development Of Civil Law Culture

As a kind of private law, civil law shows the ultimate concern for human beings, by paying attention to, supporting, optimizing the personal life and its existence, as well as the realization and coordination, and standardizing people's communicative relation. As the charter of private law and the Bible of the right, civil law becomes people's safe guarantee. When the civil law spreads extensively and pursue together for the each one social appearance, when the civil law becomes the important composition of the mankind civilization to pass the social progress, it naturally becomes a kind of cultural phenomenon. Under the background of enacting civil code in our country, and from the perspective of the relationship between civil law culture and the Civil Code, this thesis commences with the correlative issue of Civil Code and civil law culture and the relationship between them. Next it analyzes the shortcomings and values of our traditional civil cultural. Finally, it focuses on the right of personality system and civil subjects system in Civil Code which absorb and reflect civil law culture, and incarnate the interaction between them.The first part introduces the civil law culture, the Civil Code and their interrelationships. The concept of "Civil Law Culture" came from civil law's fundamental position. Its culture quality or cultural identity has become a civil nature, and had a wide impact throughout the legal life.
