There are a lot of administrative omission in the legal practices in our country which has become a serious harm to the image of the government and the breeding of the bureaucracy as well as corruption. This will inevitably do damage to the legal rights of people. In that case, it is impossible to administrative legally. Indeed, not only the recognition of administrative responsibility and the judicial censorship, but also the integrity of the administrative theory and the perfection of administrative law system can not be separated from the correct understanding of the administrative omission. But compared with the needs, current research on the administrative omission is rather insufficient. This paper begins with the definition of the administrative omission. Based on the analysis of the source and harms of the administrative omission, this paper comprehensively illustrated legislative defense and relief and it claims that the country has the responsibility to compensate for the administrative omission.This paper is divided into four chapters:Chapter I is the introduction to the administrative omission. Our country has not a uniform concept in terms of the administrative omission. In spite of these, this paper introduced the administrative omission on the basis of the four different definitions in the first section.
