Jurgen Habermas, born in 1929, learned philosophy, Psychology, History , Economy and so on, first in Georg - August University of Germany, then in Zurich University of Switzerland and Bonn University of Germany. He is the most famous contemporary philosopher, Social theoretician and the . leading role of the second generation of Frankfurt School. His work Between Facts and Norms: Contributions to a Discourse Theory of Law and Democracy, which has drawn the attention in the legal field, is considered to be his most important book and also shares the same fame with works like The Concept of Law by H ·L ·A ·Hart and Law' s Empireby Ronald Dworkin.By comprehending the book Between Facts and Norms: Contributions to a Discourse Theory of Law and Democracy this thesis focuses mainly on expounding his legitimacy theory of communicative reason and tries to analyze its theoretical and realistic sense to the present construction of China' s Socialist legal system. The thesis consists of three chapters .
