Research On Some Issues Of WTO《TBT Agreement》

WTO《Agreement on Technical Barriers to Trade》(《TBT Agreement》) is under the multilateral trade agreements of WTO. After《TBT Agreement》entered into force, it has been playing an active role during the coordination of technical trade measures of other countries,and the Dispute Settlement Body of WTO has accepted and heard several cases. This paper gives detailed analysis of several important issues of the《TBT Agreement》. Then this dissertation will offer some recommendations to application of《TBT Agreement》and dealing with technical barriers to trade issues to our country by analyzing it's status quo.In addition to the foreword and conclusion, it includes five chapters : Chapter 1 introduces the main causes because of which technical barriers to trade had come into being and the historical background on which《TBT Agreement》had been managed .Chapter 2 is mainly for the main content of《TBT Agreement》and the status of《TBT Agreement》in WTO legal system .Chapter 3 analyses some important terms of《TBT Agreement》,including the meaning of "technical regulations",the scope of " legitimate objectives " and the "necessary" standard.Chapter 4 mainly introduces the functions of international standard,and then it expounds several important issues of article2.4——one of the core provisions of the agreement through analysis of some specific cases, including the applicable scope of time,if "relevant international standards" need consensus and the definition of " as a basis".Chapter 5 analyses the positive effects and the existence of difficulties in the implementation process of《TBT Agreement》firstly. Then it emphasizes the achievements and shortcomings which lies in the application of《TBT Agreement》in China and in the process of dealing with technical barriers to trade and gives some related recommendations.
