On The Protection Of The Rights Of Left-behind Children In Rural Areas Of China

In the transitional period,China is experiencing various changes in social structure.With the deepening of new rural construction,the process of small-scale urbanization in China is accelerating,and a special group of "left-behind children" appears.In 1990,China formally acceded to the UN Convention on the Rights of the Child(hereinafter referred to as the Convention for the Rights of the Child).As one of the States parties to the Convention,the State and the Government have the responsibility to play a leading role in guaranteeing the rights and interests of left-behind children in rural areas.The law is precisely the most effective way to protect the rights of left-behind children in rural areas.One of the means.Therefore,studying the protection of the rights of left-behind children in rural areas from a legal perspective can more effectively safeguard the "dignity" of left-behind children in rural areas and ensure their healthy physical and mental development.In this paper,the rural left-behind children refer to the children who are under 16 years of age,both parents or one of them go out to work,and are left behind in their villages.At present,there are still many defects and deficiencies in the protection of the rights of left-behind children in rural areas.It is manifested in: the right to survival of left-behind children in rural areas is facing challenges,such as the right to health is not guaranteed,the right to welfare is facing many difficulties;the situation of the right to development of left-behind children in rural areas is not optimistic,the right to education is difficult to be guaranteed,and the right to play is neglected.Since there is no special law for the protection of the rights of the left-behind children in rural areas,many scholars have put forward many views on the legal protection of the rights of the left-behind children in rural areas,but there are still some deficiencies in dealing with and dealing with some problems.Based on the existing viewpoints,this paper first summarizes the theory of the protection of the rights of left-behind children in rural areas,describes the concept and characteristics of left-behind children in rural areas,points out the particularity of the rights of left-behind children in rural areas,defines and classifies the rights of left-behind children in rural areas,and classifies the rights of Left-behind children in rural areas.Thereare two main categories of right to development and right to life.Then it elaborates the meaning and concepts of the right to subsistence(mainly including the right to health and welfare)and the right to development(mainly including the right to education and the right to play),lists and analyses the status quo of the protection of the right to health,welfare,education and the right to play of the left-behind children in rural areas in China.The present situation of the protection of the right to health,welfare,education and games of left-behind children in rural areas in China has put forward specific legal countermeasures and perfect paths,which provide new ideas for the solution of the problem of the rights of left-behind children in rural areas.
