China’s education problems of left-behind children in rural areas in China is the focus of theoretical research, since2004, reported by news media into the public view, especially2011" Chinese children development compendium (2011,2020)" announced. With the quickening of the Modernization Process, the surplus labor force in China’s rural areas began to transmigrate from country to city on large scale. As the large scale of the surplus labor force migrates, the education issue of their children has become more and more serious. The left-behind children group in China who appeared in the process of socialist modernization produces the new problems that should not be ignored. This special group is directly related to the future of the motherland. The left-behind children education problems related with citizens’ right to education.This paper is made up of five Parts:The first chapter introduces the research background, research status, the paper’s research value in the basal part of the papers. In the second chapter, at the first, define the concept of the right to education, and discrimination of related concepts. Secondly, the author analyzes the content of the legal right to education. Then, explain the concept and legal features of left-behind children’s legal right to education. Finally, explain the necessity for the left-behind children education right legal protection. In the third chapter, the authors examine the American children’s education right legal protection system and the Japanese children’s education right legal protection system of two systems built for specific systems approaches. And, by the comment of American children’s education right legal protection system, it is my country left-behind children’s education right legal protection system to provide reference. The fourth chapter, the author analyzes our country left-behind children’s right to education present situation and the reason. In the fifth chapter, the author puts forward the relevant measures for the left-behind children education right. the author hopes to solve the problem of the left-behind children right to education and protect constitutional rights.
