Relative Central Right of Administrative Punishment System has been regulated in Article 16 under the P. R. China Law of Administrative Punishment, which relates to the changes of administrative enforcement system and has constituted an important stage in Chinese administrative law to a higher level. However, due to the lack of theory in such field, this system has been unpractical in the process of enforcement. Thus, an analysis on Relative Central Right of Administrative Punishment has been very necessary theoretically so as to realize the legalization, normalization and generalization of this system and to the systematic reform of administrative enforcement, and to protect the legitimate right of relating party as well.In this article, the author has probed the related issues and problems of Relative Central Right of Administrative Punishment, and put forward the basic ideas on the perfection of theory and practice in administrative enforcement within four parts.Part I Background of Relative Central Right of Administrative PunishmentBefore the Relative Central Right of Administrative Punishment was created, there had existed many issues and problems in administrative enforcement, such as government functions unreasonably defied, rights of enforcement decentralized, repeat punishment inundated, enforcement organizations overstaffed. These issues had brought lower efficiency to the administrative enforcement.Being a new style of administrative enforcement, Relative Central Right of Administrative Punishment has avoided the above issues and other malpractices by centralized organizations, law and staff with government functions reasonably defined, rights of administrative enforcement organizations centralized, repeat punishment disappeared and enforcement...
