In order to reduce the energy shortage, China formulated a series of new policies to open its electricity generating field to foreign direct investment. Thus, the electricity industry became the industry that opened to FDI before China entering WTO and the focus of international capital. The policies and regulation of electricity investment were formulated during these periods. The issuing of Electricity Law and its regulations established a good legal base for foreign investment in electricity industry.After China's access to WTO, the amount of foreign investment in China increased gradually year by year. On the contrary, the foreign investors in the electricity industry withdrew their money. There are several problems existing in foreign investment in electricity industry: project approval, contract issue, returning rate, tariff as well as the application of BOT in electricity industry.Compared the electricity industry reform and regulating with the foreign counties, we can know that the slowness of China's electricity industry reform the imperfect of regulating, especially the conflict between the Electricity Law and the reform, leads the foreign investors withdraw their money or wait to the future.This article, based on the basic law frame and characteristics of China's electricity industry and started from the current condition of foreign investment in electricity industry, dissertates the existing legal problems in this industry, analyses the BOT application issues in this industry with the example analysis method, proposes the suggestion on attracting foreign investment to this industry by the way of comparison with foreign reform and regulating system.Chapter I: basic legal frame and characteristics of China's electricity...
