The Benefit-Sharing Of Genetic Resources And The Protection Of Intellectuall Property

Protecting genetic resources (GR) is the inevitable fate we should face, the Intellectual Property Rights(IPRs) is the feasible means. However, there are many difficulties in utilizing IPRs to deal with these problems. In order to harmonizing the conflicts, complying with the goals of the Convention on Biological Diversity(CBD), combining genetic resources diversity protection and IPRs closely by the proper mechanism, becomes a profound and realistic issue.The dissertation firstly makes a research on the concepts, background and the importance of benift-sharing of GR. Based on the relationship of them, the author describes a single IPRs is not the effective means accessing to harmorizing the conflicts. That's the first two chapters places.The third chapter contains the patterns of benefit-sharing of GR and the feasibility. It provides the first full-scale account of how to integrate the requirements of the CBD into an equitable global IPR regime, taking into account ethical concerns, environmental and social impacts. Lastly, based on the two international patterns of benefit-sharing of GR, integrating with the international management examples, the next chapters develop the choices, focusing on the completion of benefit-sharing of GR.
