Research On The Issue Of Railway Passenger Transport Delay And Legal Relief

Based on the analysis of the issue of railway passenger transportation delay, making reference to the relevant rail and air transport legislative situation in foreign countries and the domestic legislative situation, this paper summarizes the legislative situation of the current legal relief to the issue of railway passenger transport delay and the disadvantages, and puts forward the corresponding legislative proposal to its legal relief. This paper is divided into six parts. The first part is introduction. The second part gives a brief overview of the relevant concepts in the issue of railway passenger transportation delay; Part III analyzes the liability rule of railway passenger transportation delay; Part IV summarizes the international and domestic legislative situation of rail passenger transport delay legal relief and pointed out the defects in the current legislation; Part V puts forward the a four-point legislative proposal to improve the legal relief:l. through improving the "Contract Law" and "railway law" and other department legislation , define the concept of " transport delay" in the strict legal definition ; 2. reference to the relevant international legislation, the liability rule of railway passenger transportation delay should be liability for fault presumption ; 3. implement the System of " compensation liability ",and set down specific rules; 4. improve the "consumer protection law" and other relevant legislation and protect the interests of consumers; Finally, make the final conclusion that the railway passenger transportation delay fault Liability principle should apply the liability for fault presumption, and the System of "compensation liability " should be improved to fully protect the rights and interests of passengers. This paper aimed at the improvement of legal relief on railway passenger transportation delay to protect the interests of consumers, with a view to promoting whole social economic efficiency.
