In recent years, Claim cases which railway passengers asked for delay succor have quickly increased daily, but should they get their compensations? In the law, Passengers have the rights to get to their final station according to the valid transportation contract and Railway companies must undertake delay duties which caused by exceptional forced. Delay succor is not only the requirement to build up perfect china trains and govern all the nation according to the law but also to protect people's legal rights and necessary development request of international trains transportation. Based on the analysis of the issue of railway passenger transportation delay, making reference to the rail and air transport legislative situation in foreign countries and the domestic situation, the paper puts forward the corresponding legislative proposal to its legal relief. This paper is divided into six parts. The first part is introduction; The second part gives a brief overview of the relevant concepts in the issue of railway passenger transportation delay; Part 3 summarizes the domestic legal relief situation delay, and gives an explanation to enter into china itself delay succor law; Part 4 in order to learn from relative rules, this passage summarizes the international and domestic legislative situation of passenger transport delay legal relief; Part 5 put forward to establish one delay legal relief system; The last passage make the final conclusion and put new points on claimer, imputation of the legal relief, compensation and penalbond. This paper aimed at the improvement of legal relief on railway passenger transportation delay to protect the interests of consumers, strengthen the succor's competent ability, finally promote whole social economic efficiency.
