The worsening ocean pollution and drying up marine resources make the ocean lose its balance. Aiming at solving the serious problem, the paper discusses on how to solve the problem in 5 chapters.The first chapter is divided into 2 parts, the first part introduces the status of marine ecosystem, and points out that people are paying more and more attention to how to keep and recover marine ecosystem. The second part introduces the development history of marine legislation.The second chapter introduces the status of marine ecosystem legislation. United Nations Convention on the Law of the Sea is introduced. The background and the contribution the United Nations Convention on the Law of the Sea made are also mentioned. Other international conventions, such as marine pollution preventing and controlling convention, diverse biology protection convention and other marine resources protection convention are also introduced.The third chapter introduce the legislation and law enforcement status of several typical countries, such as the U.S.A., Canada, the United Kingdom of British , Japan. Through comparison, the author put forward the experience that china should learn.The fourth chapter first introduces the legislation and law enforcement status of china, then analyze the flaw and deflect in legislation and law enforcement,.In the fifth chapter, the author puts forward her own idea. On the legislation, the author suggests: modify the fundamental law to complete the marine ecosystem law; establish the comprehensive management system sea area development, use and protection; make disaster preventing law in coastal area and pre-response system of marine ecosystem. On the law enforcement, the author suggests: recruit a comprehensive law enforcement team; establish a higher administration sector and reinforcement the law enforcement team.
