The Consideration Of Community Correction In China

The appearance and development of community correction is one of theimportant parts of criminal penalty, and the manifestation of criminal penalty fromserious to slight also. It reflects the internal rule of motion of criminal penalty.The development of society promotes the theories and practices of criminalpenalty, the attention to criminals' rights as well as the introspection on the way tocorrect criminals popularize the humanitarism,socialization and economization ofpunishment all over the world. The traditional system of penalty of which custodycorrection dominants has been changed to community correction, communitycorrections in the world, especially in developed countries are getting more and moremature, and playing an important role in correcting bad habbits of criminals' behaviorand thoughts, which help criminals start their lives anew.China is also obedient to the trend of criminal penalty, and has beenprogressively developing community correction based on summarizing historicalexperiences and present conditions through the way of establishing test unit. However,community correction in China is just beginning, the general level of development isvery low, many problems exist also. So, I want to take the chance of this paper tostudy the theories and practices of community correction, fmd sources to the problemsand the way to improve community correction in China on the basis of drawinglessons from foreign countries' experiences. This paper consists of Perface,Five Chapters and End.Chapter One concludes the introduction of history of community correction, theconcept and its differences from other related concepts, the nature and characters, allthese will help us to have a clear view of the fundamental questions of communitycorrection, and to comment on theories and practices of community correction aswell.Chapter Two mainly elaborates the theories based on which communitycorrection appeared and developed, in addition, this chapter explains the importanceof community correction by analyzing the defects of custody correction. Lastly, it putsforward that we should deal with community correction dialectically.Chapter Three analyses the practices of community correction in China,including looking back to history and summarizing the present institution ofcommunity correction in China. The purpose is to help us to get a general knowledgeof our community correction.Chapter Four mainly analyses the foreign community correction, includinglegislation,institution,administration,staff, etc., and tries to find out our problems inlegislation,application and administration through comparing with each other.Chapter Five mainly put forward methods to improve community correction inChina in the light of present problems, consists of legislation,application andadministration, I wish I could provide some suggestions to establish our system ofcommunity correction.
