Study In Problem Of The Community Participation In The Community Correction

Community correction, as a socialization trend of penal execution in China, carries great significance for strengthening the special precautionary functions of penalties, promoting a favoring return of criminals to society, and maintaining public safety and social stabilization. There are two forces in community correction, i.e. the one dominated by government and another assisted by community participation.Firstly, the thesis synthesizes the domestic actualities of theoretical researches through historical research and comparison method. It argues that community participation and community correction are two co-existent communities in a win-win relationship; the participation of communities into community correction is demanded by the socialization of penalty and the development of community administration. The thesis makes a preliminary probe into the basis of participation of communities into community correction.Secondly, through Positive Analysis combined with Rational Choice Theory, Social Capital Theory, Stakeholder Theory and the Theory of Supply Chain Management, the thesis draws a conclusion that there are problems of lack of participation awareness and actual participation in the participation of communities into community correction. It argues that the problems are caused by the immaturity of protecting system of rights and interests, the unformed carrier of community participation, and the unavailability of stimulation and evaluation system of community participation into community correction.Subsequently, the thesis comes up with some proposals after a preliminary analysis on the successful practice of community participation into community correction, both in Taiwan and overseas.Finally, the thesis makes a case study on Shanghai whose practice of community participation into community correction is comparatively better in China.
