The Research Of Taiwan’s Animal Protection Law And Reference For China Mainland

At present, there is no conclusive basic law on animal protection in mainland China.The legislation is relatively dispersed, and there exist serious flaws in the legal systemthereof. Some Legislative attempts have been tried but failed for the reason of futuristicnotion and “not meeting the country’s condition”. In such a foreboding situation of animalprotection, searching a proper legislative mode is the precondition of solving the problemof legislation absence. Taiwan, with its Animal Protection Law enacted in1990s, was atthat time confronted with the same problems as the current China mainland meets, andshares similar historical and cultural background with the mainland, which makesTaiwan’s legislative experience more significant. Therefore, a research on the legislationbackground, conditions and characteristics of Taiwan’s animal protection law can offer animportant idea for the building of animal protection legal system of China mainland.
