Research On The Legal System Standardization

Legal system standardization is a legal substance taking the standardization law as the center. It adjusts a country's standardization society relation. WTO/TBT is the international standardization law and it is the best rigorous law in the world.In the face of the integration of world, each country begins to setting the standardization strategy to improve the legal system standardization and international competition power. Most of the standardization laws of China were published in the beginning of 90th. But right now, it is not be suitable for the base of economy in the pace with the change of our economy system and the cash of global economy.A country'modern standardization must cooperate with international standardization and establish the international standardization development environment, than it can enter the global international standardization. It is not practical for us to make our enterprises adopt the international standardization, because of the level of the technology and economy. But we should have urgency sense and measures to be ready for linking the international standard. As far as our present conditions, it is important to compact the WTO/TBT with our own system, establish the law principle, establish the technology laws, establish standards and establish legal judgment procedures.Except the earlier remarks and concluding remarks, the thesis includes five parts:The first part researches on the general analyze of legal system standardization. It begins research on the meanings of standard and standardization, and then card the origin of legal system standardization. The part takes the legal system standardization as a legal substance taking the standardization law as the center. Legal system standardization includes two parts. The inside part is the standardization law, and the outside part is the running of system. The running of inside part and outside part mark the system whole, harmonization and workable.The second part researches on the international legal system standardization. WTO/TBT is the international standardization law and it is the world rules. It has the rich contents and firmly the base rules of international standardization working. The part gets the ideas from the research of the legal system standardization of the USA, Japan and Russia.The third part researches on the present conditions of our legal system standardization. Our system went through two stages, and they contribute to the country economy. Our system includes standardization law, standardization legal duty, standard system and standardization management. The four parts show the characteristics of our legal system standardization.The fourth part researches on the issues of our legal system standardization. The part sums up the problems, such as low legal senses, weak base working, planning economy color, not suitable for WTO/TBT and not coordination.The fifth part researches on the measures to improve our legal system standardization. The part puts forward the ideas of improving our legal consciousness and compacting with the WTO/TBT. The measures include: establish the technology law, improve standard system, improve legal judgment procedure, improve standardization management system, enlarge the standard extent, coordinate with other laws.
