Study On The Modification And Perfection Of Standardization Law Of The People’s Republic Of China

Enacted in1988, China’s "Standardization Law" has played a significantpart in the field of national standardization work as well as promoted thedevelopment of China’s standardization. With the scientific and technologicaladvances, ever-changing economic society and the new trend of standardization,China has entered a crucial transitional phase of political and economic systems,which makes "Standardization Law", arising from the planned economy, appear inall gaps with real life. Yet, the law can’t play the role of prediction and guidance.The modification and perfection of "Standardization Law" should be based on threedimensions of legislation, benefits, legal technology, so as to achieve unity of"Standardization Law" and the international and domestic standardization of thelegal systems, to give full play to the service of the national economy and foreigntrading development, and promoting the development of standardization. With thesamples of existing "Standardization Law", the thesis focuses on issues of derailmentand inconsistence between "Standardization Law" and actual situation as well as theinternational tendency, including legal guideline, standardized management system,standards and standard operating system. Considering the deficiencies for the"Standardization Law", the article gives the modified suggestions of changing legalframework, amending the existing ordinance and additional terms of content, whichconcludes of increasing the legislative principles, improving the standardizationsystem, developing the standardization work support system, and so on. From basictheoretical research, this thesis discusses the guidance of modification"Standardization Law", provides suggestion and advices on legal perfection as wellas offers a solid theoretical foundation for highly civil-supported amendment of"Standardization Law".
