Standardization Law is about the standardization of the scientific management of modern production. The current "standardization Law" of China was constituted in the 80s of the last century. With the constant development of the national economy and the change of social environment, part of the Act is no longer to adapt to the social development of our country, thus must be amended soon.The construction of Standardization legal system is discussed systemically in comparative study method in the dissertation in order to arouse more attention and encourage practical solutions to the problems.In the first part of the dissertation, the historical development of standardization was introduced, to shows the important status of the standardization in today's international market competition.Next, focus on the standardization legal system of developed countries, and analysis two important WTO Agreements: The TBT Agreement and The SPS Agreement. The development process of Standardization Law in China is summarized.In the last part of the dissertation, the unreasonable parts of Standardization Law are also analyzed, and then new countermeasures are envisaged, based on the situation and demand of China with the successful legislative experiences of other jurisdictions for reference. The most remarkable features of the dissertation consist of:The first is the comparative method taken in the dissertation. Compare the differences of legal systems in Standardization in ancient time and modern society, in China and foreign countries, and probe the track and features of development of Standardization.The second is the positivism method taken in the dissertation. The Standardization is discussed not only theoretically but also in way of positivism. The legal system and relevant cases are also reviewed in order to take out some principles scientifically.The last is the specific legislative proposals offered in the dissertation. With the intention to improve the legislation, the impropriety parts are pointed out based on the study of positivism and comparison, and the specific legislative proposals are put forward in the dissertation.
