On The Legislation Of Wage Payment

Solving the problem of wage payment based on law is the key to the establishment of a compatible society and the guarantee of social justice. Under the new situation of the variation of workers, the diversification of labor recruitment, and the complication of working relationship, the number of working disputes is rising, and such illicit scenes as the arrears or skimpiness of wage is becoming more and more; therefore, legislation is the only one effective way to the problem of wage payment from the aspect of origin and system. However, the national legislation on wage payment is few and far behind the demand of development. Various provinces have established local rules on wage payment for the purpose of meeting the objective demands arising in the new age of reforming and development, protecting the rights and interests of workers, and enhancing social justice and stabilization, such as Guangdong Provincial Rules on Wage Payment published in 2005. The rules have provided system protection for the workers' right of wage payment, refrained such illicit actions as the arrears or skimpiness of wage elementarily, and protected the workers' rights and interests effectively, but due to the localization of legislation, the defects in itself have influenced the effect of the rules. Therefore it is necessary to perfect related local rules, and China shall perfect the legislation on wage payment based on the experience of related local legislation according to the development of economy and society.
