Constitution is the fundamental law of a country. Every alteration will affect both the national and social life greatly. In the New Constitution Revision of New Constitution, one important item is to emphasize the guarantee of human rights. The rights of the police are an important part of national rights. The actual working condition of them marks the developmental level of law civilization and reflects the condition of the guarantee of human rights. But under some circumstances, the rights of the police is in inverse ratio to citizenship, that is to say, the expansion of the police rights means the shrinkage of citizenship, the abuse of the rights of the police tends to make citizenship become nothing. Therefore, a police society and a law society are usually contradicting. A police society means rights, which are lack of restriction, are over the law. While a law society puts the law over everything, the rights must obey the law and restricted by the law. Now the guarantee of citizenship is pointed up in the Revised Edition. It embodies the idea of emphasizing human rights. The guarantee of human rights needs formalization and restriction. However, currently, in our country the rights of the police are monopolizing, wide-spreading and powerful, which has become an obstacle to the proper use of citizenship. So advocating human rights means to restrict the rights, especially the rights of the police. To restrict the rights of the police, some methods, like dividing rights, should be adopted, and the rights of relative ownership of the police rights should be improved. Then the final purpose of perfecting the rights of the police to guarantee human rights will be achieved.
