Dialectic Analysis Of Public Interests' Realization

The most important objective of public administration is to earnestly safeguard, effectively improve and equitably distribute public interests. In the current field of public administration, New public Service Theory and Governance Theory highlight public interests in an outstanding manner, regarding these interests as the starting point in logics and the purpose of the drive of reforming government into a service-oriented one. With the development of socialist market economy, deepening of reform and opening-up, and diversifying of social interests, the study on public interests has become a hot topic in China.Firstly, This paper reviews the Western and Chinese concepts on interests,public,public interests , The following focuses on the analysis of the dialectic relation between public interests and personal interests. On one hand, public interests and personal interests are of the identity in nature, in that they transform into each other and there is overlapping parts between them; on the other hand, they are contradictory to each other, in that one increases sometimes inevitably at the expense of the other. To solve the contradiction between public interests and personal interests, we should take necessary measures: corresponding laws to define the subject (principal part) and the scope of public interests should be formulated; when dealing with the contradiction, we should abide by the proper legal procedures which guarantee the legitimate rights and interests of citizens; when the personal rights and interests are violated for the sake of public interests, the corresponding persons have the rights to obtain relief according to law; last but not least, when public and personal interests come into conflict, a proper balance should be struck in an equitable manner.Secondly , we mainly deals with the dialectic relation of public interests and governmental interests. While it is the public interests that decide the basic orientation of the activities of the government, the public interests and governmental interests contradict with each other. Then deal with properly the relation of public interests and governmental interests from the following three aspects: implementing limited administration, namely controlling the governmental self-benefit according to the law; transforming the functions of the government, making government limited in nature, putting in place the competitive mechanism of public service, diversifying the supply and distribution of public goods and public service; combining the ethics with the system in constraining the behavior of administrative persons to ensure the realization of public interests.Thirdly, This thesis attempts to analyze the dilemmas concerning the realization of public interests in current Chinese realities in the following respects: the fact that the laws and institutes are not well established; the mechanism of supervision is imperfect; the devotion of capital is insufficiency. Combining the realities in China, an analysis of the absence of public interests in the activities involving administrative expropriation (such as the expropriation of land and the demolish of run-down houses)as well as education, health care.Lastly, How to realize public interests? We should tackle this problem from the following respects: to establish diverse management system to realize public interests; to lay a solid legal foundation for the realization of public interests; to improve the institute and system for the realization of public interests; to provide the policy support for the realization of public interests; perfect the supervision system for the realization of public interests; to guarantee the funding for the realization of public interests.
