The Study Of Administrative By Law During Constructing Socialistic Harmonious Society

Constructing socialistic harmonious society and improving the ability to establish a harmonious socialist society is an issue of great importance proposed in the Sixteenth Central Committee of the Party and its Third and Forth Sessions. Carrying forward lawful performance of official duties is important content and urgent need of establishing harmonious socialist society. The construction of socialistic harmonious society needs the transformation and innovation of the system of social administration, the science of political policy-making, the democracy of political goal and the legality of political administration and during which the administrative power will play an important role. It is a social systematic engineering with high complexity to build the socialist harmonious society. The key to realize this goal is the government. It is the inherent demand and important aspect of building the socialist harmonious society for the government to administrate by law. The government must standardize its power and advance administration by law in an all-round way. The goal of socialistic harmonious society can be realized through the social law-ruled government with high quality. Therefore, to explore the function of administrative in law during the construction of socialistic harmonious society has great theoretical and practical significance.This paper was accomplished by means of relating theories to practice, analytic comparison, interdisciplinary and mathematical analysis, etc. The problems related to the functions of administrative by law in constructing socialistic harmonious society were also explored in this paper. In the first chapter, the theme and background were introduced, and the social background and significance of building the social harmonious society, the scientific connotation and basic characters of socialistic harmonious society, the social backgrounds, connotation, significance of administration according to law and its relation to the construction of socialistic harmonious society were explored. The theme, significance, research ideas and method were also introduced. The second chapter explained the important status of administration according to law in the construction of socialistic harmonious society. Administration according to law is both the basic precondition and important guarantee of building a harmonious society. The third chapter discussed the specific effects of administration according to law in constructing socialistic harmonious society. On the one hand, its generative effect for maintaining fairness and justice, establishing the honesty and faithfulness in society were explained. On the other hand, its ensuring function for democracy, the rule of law, maintaining social stability and order, people's living harmoniously with nature were discussed. The forth chapter analyzed the factors influencing the functions of administration according to law in building socialistic harmonious society, such as relatively slow government function, problems in legislation of administrative law and administrative enforcement of law, lack of effective restricting and supervisory mechanism for administrative power and low quality of law enforcing team and low level of law enforcement. The fifth chapter raised some solutions for functions of administration according to law in constructing socialistic harmonious society as follows: increase the awareness of performing official duties lawfully and institutional quality, strengthening the supervision over power and improving ability of civil servant's administration by law. In the sixth chapter the conclusion and innovation of research were concluded and the research outlook was also raised.
