On Magistrates Supervision

The supervision is the guarantee to realize the function of the government and a important method which can prevent the abuse of the authority, the power for personal gains and authority disassimilation. It is also the essential condition to guarantee the nation operate normally, coordinated, highly effective.《Law of All levels of Standing Committee of the National People's Congress of the People's Republic of China on Supervision》prescribes that "all levels of National People's Congress stand committee should revolve the general situation of the national work and take the economic development as a center.We should persist the leadership of the Communist Party of China and Marxism-Leninism,Mao Zedong Thought,Deng Xiaoping Theory and the important thought of 'Three Represents' and the people's democratic dictatorship, the socialism road and open policy when exercises the supervision authority."Magistrates may abuse of their authorities because of the trait of public power, human defects and the provincialism. It is necessary to supervise local governments. "Counties seat, then the world governs" . We should strengthen the supervision of the magistrates' rights if we want to govern counties well. The county magistrate is the major person in charge of county government. We can ensure the normal workings of county governments only when we strengthen the supervision of county magistrates.There are standard researches in studies in studies of supervisions of the cadre in most research results and few special researches in the county supervision. The article attempts to combine standard research and the real diagnosis research and carries out the research of the magistrate supervision.This article outlines some positions and methods of the magistrate supervision from characteristics of the county supervision in agencies of organizations and relations of the authority assignment. Based on this, the research takes the general situation of the magistrate supervision in the county as an example. It proposes to establish mechanismment that strengthens and consummates the administrative supervision from three aspects, the system, the mechanism and achievements. That is to perfect self-discipline and heteronomy system to form the network of the heteronomy supervision; to combine education, supervision and publishment to form the persistent effective supervision mechanism and display each subjective initiative of the supervision of the main parts and makes flexible and various modes of supervision. The author thinks the actions are advantageous to guards against malpractices in the operation of administrative rights in counties and establish perfect punishment and the prevention corrupt system and legal system of administrative supervision and corresponding supervision mechanism.The full text is made up of the introduction, three main parts and the epilogue: The introduction mainly expounds the origin of the thesis, the value of theory and the practical significance.
