A Study On The Perfection Of China's Legal Relief System Of Urban Vagrants And Beggars

The phenomenon of the professional "wanderers-between-relief-units" is a new social problem with the promulgation and implantation of our "Aid and Management of Urban Vagrants and Beggars". These wanderers-between-relief-units do everything possible to swindle the relief as their occupation by skillfully making use of the loopholes in our system. And they have done nonnegligible harm to the society. Based on this phenomenon, this text attempts to study on the legal relief system of urban vagrants and beggars. It analyzes the current situation and problems of urban vagrants and beggars from two aspects of both the static obstacle of the legal system of social relief and the dynamic substantial results of the legal system. There must be some deep-seated reasons behind any problem or contradiction. The embarrassment of our social relief is caused by the friction, fracture, and even confliction in the process of our economic system transition and social mechanism accommodation. And this should be our initial point and basic premise to consider and evaluate this legal system. Exactly on this point, this text concludes the social reasons and background causing the problem and perplexity in the social relief of urban vagrants and beggars, to provide a basis for a fundamental resolve. The old saying goes, "know your enemy, know yourself. So, the author then makes a comparative study between the relative system in UK, US, France and Germany etc. and the practice in our developed and under-developed areas. The horizontal and vertical comparison of the legal system and practice of social relief gives the author a beneficial revelation on the legislation and its operation. And according to our economy and social development, the author makes some localized renewal and transplantation, to put forward some suggestions on our legal social relief system of urban vagrants and beggars. In the meantime, the author thinks that the social mobility and floating population are the necessary result with our commercialism and the development of our market economy. So, not limited by the concrete problem in social relief, this text attempts to study on the possibility and feasibility of the relief socialization from the macro angle of the establishment of a transition platform for the rural floating population urbanized in the industrialization and commercialization of Chinese society. The author hopes to make a contribution to the perfection of the whole legal social relief system and the construction of our harmonious society.
