Research On Legal Issues Of Relief Of Vagrants And Beggars

Throughout the ages, both in developed and developing countries, begging as a special way of life has been existing for a long tim e. In modern times, with the coming of large numbers of vagrants and beggars,an adverse social phenomenon appears,it hinders the healthy development of society,nuisance to mem bers of the community to norm al life,affecting the local social order,social harmony and development constraints.With the commencement of begging law and the beginning of the work of relief and management, a growing num ber of scholars have carried out researches, the study on social relief of vagrants and beggars abroad is relatively mature, and it has a strong practical significance and practical value.In contrast,the research from Chinese scholars is relatively scarce,it becomes a big shortage.In the introduce of social relief of vagrants and beggars,a general analysis comes m ore than a substantive exploration,the research of how to solve the funda mental problem of vagrants and beggars is not enough.Therefore,this article attempts to explore the legal issues from four parts.The first part explains the fundam ental theory of relief of the vagrants and beggars,concluding the related concepts,the di fferences among three types of vagrants and beggars,four theoretical basi s of relief of the vagrants and beggars,the concept of human rights,the concept of equality,the concept of S tate’s responsibility,and the concept of justice.The second part describes the law of relief of the vagrants and beggars in UK, US a nd France,and summed up three aspects which wo rth our reference,including focusing on legislation,social forces to participate in a high degree of relief,and the work of relief in diverse ways.The third section describes our current thre e regulations on relief of the vagrants and beggars,including<The Law of Rel ief And Management About The V agrants And Beggars In Cities>,<Implementing Regulations of The Law of Relief And Management About The Vagrants And Beggars In Cities>,and<The Law of Social Relief>.Based on the current study,five obvious problems come out,they are:the relief was limited to the city,social forces to p articipate in a low d egree of relief,the relief is no t in comprehensive manners,unclear responsibilities between the civil af fairs departments and other relevant departments,the rights of people who get the relief is not enough.The fourth part focuses on the five problems above,on the basis of combined British,US and France on legal experience of relief of the vagrants and beggars,put forw ard solutions respectively,including breaking the limit of relief that only in the cities,increasing the degree of social forces to participate,increasing diversification of the mode of relief,clear responsibilities between the civil affairs departments and other relevant departments,and strengthen the ri ghts of people who got relief,in order to promote the development of the work of relief,especially the first point.At present,relief of the vagrants and beggars only concerned with the urban population,there’s no legislation or m easure about countries,so we should break the restrictions,to benefit more people who need the help.
