Study On The Problems And Improvement Of Infectious Disease Responding Regime In China

Infectious diseases have affected social and economic development since ancient times,and SARS in 2003 brought a heavy blow to China's economy.After SARS,the state attached great importance to the prevention and control of infectious diseases,promulgated a series of laws and regulations and gradually established a system for the prevention and control of infectious diseases.With the effects of global integration and the change of environment and social activities increasing,in recent years we face the new situation of infectious diseases in our country,some already disappeared infectious diseases are resurgent,at the same time there is a kind of new infectious diseases outbreak or epidemic every few years in the world,there are many new problems in responding infectious diseases.Although China has built a legal system for dealing with infectious diseases based on the law of “prevention and control of infectious diseases”,in practical work,there are still some problems,such as unclear administrative subject qualification of infectious disease prevention and control agencies,separation of professional technology and law enforcement,lack of strong legal protection for the implementation of infectious disease control measures,poor coordination mechanism of multi-department management of infectious diseases,and low cost of individual violation of laws.In the implementation of infectious disease control measures,there are also problems such as how to balance the performance and rights protection,how to establish and perfect the compensation mechanism.This paper aims to discuss the problems existing in the epidemic disease responding regime,and to describe and analyse the current situation of China's epidemic disease responding regime,and put forward its own views and suggestions for improvement.There are four chapters,the main content is as follows:The first chapter is about the multiple prevention and control subject of infectious diseases and its existing problems.This chapter expounds the connotation of infectious diseases and the selection of responding subjects,introduces the various responding subjects of infectious diseases in China,and finally puts forward the existing problems of responding subjects of infectious diseases in China.Chapter two,infectious disease responding mechanism and existing problems.This chapter elaborates from five aspects.The first part compares the classified management mechanism of infectious disease between China and extraterritorial.The second part describes the discovery and reporting mechanism of infectious disease in China.The third part introduces the multiple responding mechanism after the outbreak of infectious diseases in China.The fourth part introduces the responding mechanism of extraterritorial infectious diseases,and the fifth part discusses the existing problems of responding mechanism of infectious diseases in China.Chapter three,the protection of citizens' rights and interests in dealing with infectious diseases and the existing problems.In the implementation of infectious disease control measures,the protection of the rights and interests of infectious disease patients and related personnel has not been paid attention to,how to take into account the effectiveness of infectious disease prevention and control measures and the protection of rights and interests has been a difficult problem in the prevention and control of infectious diseases.Citizens' right of personal freedom,property rights and labor rights are easy to be directly affected by infectious disease control measures.The compensation mechanism for infectious diseases also needs to be further improved,and the compensation mechanism often directly affects the implementation of control measures,thus affecting the occurrence of infectious diseases.This chapter focuses on the protection of rights and interests and compensation mechanism in infectious disease response.Chapter four,suggestions and ideas on improving China's infectious disease responding regime.In view of the problems raised in the first three chapters,this chapter puts forward its own suggestions and assumptions from three aspects,they are: first,improving the top-level design of infectious disease response;second,improving the relevant legal liability and response mechanism;third,improve the protection and compensation mechanism for citizens' rights and interests in response to infectious diseases.
