With the development of financial internationalization and liberalization, the free flows of capital globalization trends continue. The rapid development of financial globalization positively contributes to the world economy, trade and financial development. But on the other hand, the tremendous risk of the international financial industry, the host of political, the negative impact on the economy should not be overlooked. To some extent, it is a problem to establish a national financial system which will help to promote and enhance international competitiveness but also helps to attract international capital flows to the country and can effectively preventing financial risks open system.With the further opening up of China's financial market, foreign shareholding commercial banks have become the main theme of opening up the banking sector. We also triggered widespread debates on foreign-funded banks'entering effect. It is also a great problem to take more robust measures to ensure that the pace and to the maximum enjoyment of the benefits of international capital flows, financial services open to minimize the risk. China's financial system and financial supervision legislation must address and solve major theoretical and practical problems. Therefore, in this paper, starting with the entry of foreign-funded banks, combating the theory and case law analysis of the financial crisis, the author proposes legal suggestions with a view to improve the legal system.The whole dissertation is composed of four chapters.Chapter 1 outlines the opening of China's banking industry, including its accession to the WTO before the financial markets open. And, China's introduction of foreign-funded banks also for the case summary is concerned.Chapter 2 discusses the impact of foreign-funded banks into China's financial stability as a result of legal problems. First, relaxing control is one of the important legal considerations for foreign-funded banks to enter the financial system. Second, there are possibly three negative legal consequences as a result of foreign-funded banks'entering.Chapter 3 discusses the financial crisis, from an international perspective and theoretical analysis of the legal case, citing the financial crisis in Mexico, East Asian financial crisis, the Russian financial crisis and the financial crisis in Argentina.Chapter 4 proposes the legal suggestions to the financial stability of legal system.
