The International Voluntary Service, Community Voluntary Service and Youth Voluntary Service activities provide lots of service in the fields of education, environment protection, poverty assistance, health service, security assistance, agriculture production assistance, etc. In the aspect of using the legal standard to voluntary service behavior, the advanced experience obtained by the western developed country is worth our country profiting from with the study.As a noble socialized behavior and an important social welfare business, voluntary service has a outstanding significance in helping form the perfect social security system, helping form the solid social order, promoting the socialization of youth, being beneficial to the economy development and moral standard improvement. All in all, the voluntary service plays a crucial role in constructing a harmonious society and promoting the advancement of human beings.Unfortunately, the voluntary service in China is facing many difficulties, mainly lack of related legislation, in the moment, which seriously limits the development of voluntary service in China. To solve the problems, we must draw up the perfect voluntary service law, establish the Chinese characteristic voluntary service legal framework, on the other hand, strengthen the construction of voluntary service organizations, improving the voluntary service standard. By taking the efforts above, we hope to promote the development of voluntary service in China.The thesis is divided into six part, including the summarizes, the characteristic of voluntary service behavior; the contrast and analysis about foreign voluntary service law, the present situation and question of Chinese voluntary service law and rules, the solutions to establish the Chinese characteristic voluntary service legal framework, and the conclusion. The thesis focused on the legal characteristic of voluntary service behavior, and compared with voluntary service law and rules between two big legal systems in the West, by analyzing the consistence, form, characteristics, development situation, the social and positive functions of voluntary service, of the West volunteers. At the same time, the thesis analysis the related issues from the aspect of law, and trying to give some solutions to the problems in the development of voluntary service in China.
