Complicated international trade reflected the interests contest among countries. The intrinsic quality of competition is maximum the states' interests. The pursued of benefits demand every country of WTO grasp the essence of trade rule. Many years' experiences force lots of country come to a common understanding: the purpose we obey the rules and better use of it is to restrict others so to protect ourselves, wins more benefits. Rules are like elastic, if you use well, they will bring you advantages as tools and chips, but not shackles nor fetters. No man wants to gain benefits with cruel aggression and brutal pillage, quote and NBT is also not that satisfied. Only neutrality way is the best choice. Obviously, recessive trade barriers win a brilliant seat because of its seemingly lawful, conceal and discrimination, people couldn't discriminate it from the real labor, environment, hygiene and safe measures. This is really a thorny problem; the essay sums up the common characteristics of some recessive trade barrier measures from numerous examples with solid international trade. The author believes: only to build up a whole set of rules to distinguish the recessive trade barrier, then can we stop biases and prejudice, and guide the international competition to develop continuously toward the direction of fairness freedom and health.China gains a lot after access to WTO, but also loss a lot due to the recessive trade barriers. There are many trade friction in agricultural products, SPS, TBT, rule of original, safeguard measures, and GATS. Considering the above-mentioned situation, the author studied recessive trade barriers thoroughly, By collecting as much information as possible, taking the existing problems of China into international laws and national legislation of other countries, making some suggestion on the counter measures of recessive trade barriers. The author hopes that the article can offer some recessive trade barriers theoretical support to the constructing of the relevant legal system and perfecting of the relevant legislation.
