Analysis Of Our Local Legislative Hearing

The Legislative Hearing System demonstrates justice and democracy pursued by modern legislative system and symbolizes the maturity of legislation. Originating from the Judicial Adjudication System of capitalist countries and with the wide use and development of the Judicial Hearing System, the Legislative Hearing System was finally transplanted into legislative system and has been employed by legislation of many countries in the world. As a major form of democratic legislation, legislative hearing is popular in the legislation of western countries, reflecting essentially citizens'political participation. Considering that, in China, it still remains at the demonstration stage, it is of vital significance to integrate legislative hearing, the main form of democratic legislation, into local legislative procedures.However, there are still many demerits of local legislative hearing system for its short practice in China which are mainly categorized into lack of uniform proof, insufficiency of social recognition, a narrow scope of legislative hearing and unclear legal effect of hearing results. These shortcomings will seriously hinder the growth of China's local legislative hearing and even worse, affect the democratization of local legislation.In view of the above-mentioned problems, the author suggests that in the first place, China should make law for legislative hearing to guarantee and standardize the legal proof of hearing; in the second place, China should extend the public consciousness of legislative hearing and third, focus on the treatment of hearing results to fully exert the function of hearing and finally, establish hearing agent and written hearing system.
