Research For Criminal Policy Of Drug-Related Crime

As the most serious social harmfulness crime, the drug-related crime is always the crackdown and prevention key point for countries all over the world and international society. Presently, with our country's politics and economy transition, and the influence and permeance of international drug-related crimes, the drug-related crime has developed and extended quickly. So, it has seriously affected our country's long-term peace . In order to contain and severely attack the drug-related crime, therefore, studying, discussing and establishing criminal policies which focuses on the drug-related crime punishing and prevention becomes the most pressing matter of the moment. The criminal policy for drug-related crime is a new field for crimes criminal policy in our country and lacks special and the systematic characteristic. There are various differences of the drug-related crime in the theory and the judicial practice.This article which takes the study of the generalized criminal policy as the research angle and unions the elementary theory of the criminal policy, carries on the inspection and the evaluation to the criminal legislation, criminal judicature, criminal execution and the the social preventing works of drug suppressing for our country from the angle of criminal policy structure. Also, the author will bring forward his own suggestions for improving the criminal policy for the drug-related crime in our country.Except the foreword part and concluding remark, this article will divide into six chapters with fourty thousands Chinese characters in all.The first chapter altogether divides into two parts. To study the drug-related crime must take a definition for the drug-related crime at first. The main discussion of the first part is the concept of the drug-related crime. The author has also drawn his own conclusion. The second section will introduce the development phases and analyz the present situation, the characteristic, as well as origin of our country's drug-related crime. And will carry on the forecast of the development tendency to the future for the drug-related crime in our country.Based on the analysis to the definition and the structure of the criminal policy, the second chapter will briefly introduce the strategy of criminal policy for our country's drug-related crime and the present situation of criminal policy for our country's drug-related crime under the vision of the two-pole criminal policy field. This chapter will echo with the first chapter and make the conclusion: "Gently layer on layer, by is heavy primarily" is the inevitably choice for our criminal policy to the drug-related crime.From the third chapter to the sixth chapter, this article will carry on the inspection and the evaluation to our criminal policy for drug-related crime separately from the criminal legislation policy, the criminal judicature policy, the criminal execution policy and the criminal society policy angles. On the baes of "Gently layer on layer, by is heavy primarily" ,the author will bring his own suggestions for improving the criminal policy for drug-related crime in our country from these four aspects.At last, my tutor Prof. Gao yuexian has offered some favorable advice in my writing of this thesis, I would express my sincere thanks to him.
