Administrative Law College Student Management Behavior

With the speeding of the course of our country rule by law and the strengthening of the consciousness of individual right,the right consciousness and the rule by law standpoint have penetraten into the realm of higher education managing.In recent years,the lawsuit cases of higher education managing are increasing gradually.These cases colleges and universities attach importance to the law issues in students managing,and turns into the necessity of the age developing.This article mainly expounds and studys the students managing of higher school from the direction of administrative law and follows the consciousness of administration according to law and managing school according to law.Takes the foreign advanced study methods according to state of our country to make student management in higher school working standard by law,by amplifying the managing procedure of the law and perfectly channel relieving urges and restrict the power of student management in higher school to ensure practically the legal right of students.This promotes and perfect the higher education system of our country from the direction of the administrative law.The thesis mainly approachs the question of student management in higher school by theory relating practice,comparing,documentary,analyzing and precedent analyzing,then discusses from the direction of administrative law.This thesis mainly analyzes from three parts.First,the thesis orientates the law position of higher school,the law relation of higher school and students again by analyzing the base of administrative law which student management in higher school exist,then define the legal person position of higher school and take foreign privilege relation to judge the law relation of higher school,so consider the nature of student management in higher school is mainly the relation of administrative law,but also contoin the relation of civil law.Second,the thesis raise the reason why problem exist,and the embody of the problem by analyzing the problem which the interior student management in higher school exist,and take foreign study achievement of suiting our country condition to perfect our student management in higher school of our country by analyzing the foreign study achievement of student management in higher school work.Last,the legal standard manages which from the consummation is from improving the legal norm of student's administration behaviour of institution of higher education, execution strength and student law of right of legal norm relieve and improving administration behaviour supervision mechanism of course,etc. respect, student of institution of higher education, establish the idea of managing the school in accordance with the law, standardize student's administration behaviour of institution of higher education, promote the healthy and orderly development of student's administration behaviour of institution of higher education.
