Whenever people mention"Song shi", the image of a villain without righteousness appears in their mind's eyes. And maybe the some argumentations supposedly associate them with"traditional Chinese lawyers", but unfortunately, they had little in common. In ancient China, the occupation of the"Song shi"had never a chance to develop becoming professional lawyers. On the contract, they were forbidden and punished by the government owing to their ungraceful behaviors such as lawsuit assistance and elusion which would break traditional judicial system and social relationship. Mainly through the study of legal and historical literature materials,"Song Shi", the research objects of this article, will be explored. By analyzing and answering the central question of why"Song Shi"have greatly developed in the Ming and Qing dynasty, and what were their personal statements, professional career and legal status in current legal system will make a clear understanding to this ancient occupation and in the meanwhile, provide us a new point of view that the"Song Shi"still have their positive effects in history. In the Ming and Qing dynasty China, a full flourish development of"Song Shi"might push the traditional legal system to be improved. However, through the pressing by the conservatism and traditional legal culture, people missed this unique chance.
