On The Improvement Of The Legal Guarantee Of Public Security Funds In China

Public security organs are the important parts of the national organizations. They attack criminals, maintain social security order, protect the people's human rights and assets and consolidate people's democratic dictatorship. Based on the characteristics, public security organs should be financed by the state. In 1995, China promulgated The People's Police Law, which provides legal guarantee to the public security funds, and upgrades the matter of public security funds to the basic-law level. This symbolizes the legal guarantee progress of public security funds. However, the provisions of The People's Police Law are too general and lack of maneuverability, and public security funds budget isn't listed specially in the finance budget. So this has brought about a series of problems to public security work. Self-financing has seriously affected public security organs in the people's image. The existing legal guarantee of public security funds is not perfect, it needs to be improved.This article choose a prospective of Law Science, combining the legal guarantee of the foreign police funds, and apply the historical, economic and comparative methods to the analysis of the legal guarantee of public security funds. First it introduces the evolutions of the legal guarantee modes since the foundation of new China. And it analyses the status quo and flaws of the legal guarantee. Then it dissects the importance of legal guarantee and the irrationality of self-financing. Based on the reality of our country, extracting the legal guarantee of foreign police funds, it advances a few practical measures to improve the legal guarantee of public security funds. The measures include seven aspects. (1) Revising The People's Police Law and building the law guarantee of public security funds. (2) Defining functions between the superior public security organs and the subordinate public security organs, improving the grading financial guarantee. (3) Specifying the budget rations and establishing the standard of funds guarantee. (4) Defining the partitions of areas and establishing subsidy mechanism. (5) Establishing effective funds management and surveillance mechanism. (6) Establishing participation mechanism for the social insurance. (7) Establishing"input"and"output"assessment mechanism to improve efficiency of the public security work.
