On Construction Of New System Of China's Entry And Exit Administration

After China open to the outside world, especially accede to WTO , persons entering and leaving China are growing very fast. The administrative work of entry and exit is facing new and complicated situation. There are many disadvantages in present system of China's entry and exit administration, which have hired the development of administrative work. It's necessary to reform the present legal system, and construct the new system of entry and exit administration.Two things account for the reform. First, the present situation, the reason as follows: (l)The increasing of work load leads many new problems; (2)Administrative laws are being perfected, which lays a foundation of enter and exit administration legislation; (3)Shifting government's administrative functions and patterns demands the administration of entry and exit turns ordering to guiding. Second, the disadvantages of present system are as follows: (l)The administrative organizations are overlapped; (2)The duties of certificate issuing organizations are intersected; (3)The frontier inspection administrative systems are being in confusion. There are two different types in China or even in the same province; (4)The legal systems of administration of entry and exit are not established.Chinese entry and exit administrative work must use the experience of other countries for reference. The thesis introduces many countries' ways in organizations system, personnel system, law system, etc. The thesis provides tentative ideas on new system of China's entry and exit administration. First, the most important and essential thing is to setting up the perfected legal system which conform to present Chinese entry and exit administration. we should have an "entry and exit administrative law". On the entry and exit administrative legislation, the thesis makes a key analysis of the focus points and difficult points of the work. e.g. How to readjust the entry and exit administrative law and other relative laws; Some special decision, such as being forbidden to leave or enter the country made by the public security department or the state security department of the State Council should be legal; REGULATIONS OF THE PEOPLE'S REPUBLIC OF CHINA ON EXIT AND ENTRY FRONTIER INSPECTION should be absorbed into the "law", and the skills on the legislation. Second, to construct the new system of the entry and exit administration, other three aspects also should be pay attention to: To straighten out the systems of the entry and exit administration; To develop the science and technology in entry and exit administration; To train the personnel and enhance the professional quality.
