Trying To Discuss The Copyright Permission Of Our Digital Library

In the network time, under the present legal frame, the digital library is facing the copyright permission barrier which is unable to overcome. The copyright permission is the core and the key to solve the digital library copyright problem. In view of the realistic need of the digital library, this article researches the system construction of the copyright licensing, proposes the specifical basis and method of solving the problem and expects to impel our digital library growing strong in the legal stratification plane.The first part of this article first introduces the concept, the characteristics of the digital library and the profound influence on the traditional library by digitized technology; Meanwhile classifies and indicates that this article mainly studies and elaborates the profit-earning digital library which carries on the commercial operation; Finally describes the high tide of constructing the digital library in various countries including our country. The second part discusses the copyright disputes of the digital library. First, I point out the huge impact on copyright by digitized technology, enumerates many copyright dispute cases, induces the rights mainly involved; elaborates key links in which disputes produce; Finally analyzes, summarizes and discovers the crux of the copyright disputes----copyright permission. The third part compares and researches those main developed countries, international organizations with our country in digital copyright permission legislation. Points out that our present legislation is pale and weak, various countries have provided the precious experience to our country according to the right limitation, legal permission, copyright collective management and so on. The fourth part constructs and designs the copyright permission system of our digital library, it is the core and essence of full text. Mainly from seven aspects: the rationale, the legislation guiding ideology----benefit is balanced, the information network broadcasting limitation, stipulating the right concurrently duty of clear instruction of copyright permission, setting up the authorized important contract pattern, introducing the forced permission, expanding legal permission scope, formulating the cost standard of copyright as well as perfecting copyright collective management, I put forward proposals.
