Impact Of Economic Globalization On The Development Of Anti-Monopoly Law

Economic globalization, as a natural product of the development of the social productive forces and human social history to a certain stage, will bring great impact on social and economic life, which is necessarily reflected in the law. Economic globalization is actually a unified mechanism for the global market regulation and operation. The anti-monopoly law is to regulate the monopolistic behavior preventing competition and maintain competition in the market, safeguard the effective functioning of the market mechanism. In this sense, economic globalization is bound to have great impact on the development of an anti-monopoly law, and propose new requirements.With the continuous development of economic globalization process, academia has made a lot of achievements in research on economic globalization and the anti-monopoly laws, but from economic globalization perspective, there is a lack of systematic research on the anti-monopoly law, especially the systematic analysis on the impact of the economic globalization on the development of an anti-monopoly law. This article, on the basis of the existing theoretical results of economic globalization and anti-monopoly laws, mainly illustrates the following issues:First, the writer introduces the basic theories of economic globalization and anti-monopoly laws. The basic theory of economic globalization includes globalization, economic globalization, the advantages and disadvantages of economic globalization, interaction between economic globalization and the legal system. The basic theory of the anti-monopoly law includes the concept, nature, characteristics, basic contents and system of the anti-monopoly law and the concept and characteristics of international anti-trust laws.Second, the writer illustrates the impact of the economic globalization on developing trend of the domestic anti-monopoly law, and the trend of weakening domestic control of the anti-monopoly law and strengthening of the international control.Third, the writer explains the right impact of the economic globalization on the development of the international anti-monopoly law and the impact of WTO principles on the development of international anti-monopoly law and the impact of economic globalization on the style of the international anti-monopoly law.Fourth, the writer expounds the impact of the economic globalization on China's legislation of anti-monopoly law. This part is about the current situation and characteristics of China's anti-monopoly legislation and the impact of the development of anti-monopoly law on the development of China's anti-monopoly law, and forwards proposals of strengthening and improving China's anti-monopoly legislation under the background of economic globalization.This article aims at objectively, truthfully and comprehensively showing theinterrelationship between the economic globalization and the development of the anti-monopoly law through the research and analysis on the economic globalization and the development of the anti-monopoly law and furthermore, summarizing the rules so as to supply a reference for the research and development of China's anti-monopoly law to a certain extent, and contribute to theoretical research and fertility of the theoretical results.
