From 2004 onwards,to counter the rising price of housing,people demanding for housing in some regions of China have found a new model for building and purchasing house individual cooperation in housing construction to put up a silent resistance on the status of the price.The model of individual cooperation in housing construction has fully integrated the social forces for purpose of the realization of the desire for getting housing ownership with a low-cost as purpose.In terms of the characteristics of this model,it will play an important part in solving the housing problem of medium and low-income people.However,at present,the legislation in the field of personal cooperation in housing construction has lagged relatively behind,the original residential cooperatives have been no longer meeting the needs of people.It should be regulated and improved in the legislation first in order to promote the development of individual cooperation in housing construction.By analyzing the existing organization forms of individual cooperation in housing construction and comparing it with the organization forms of residential cooperative and company,the thesis reaches a conclusion that partnership is the reasonable choice for individual cooperation in housing construction for the time being,and based on which the thesis further clarifies the internal and external legal relationship involved in individual cooperation in housing construction,and defines the rights and obligations between the partners and between the partners and a third-party,thus making it run smoothly.Meanwhile,in order to ensure that individual cooperation in housing construction truly become part of safeguard mechanisms,the identity of the partners should be limited.The specific conditions can be defined by local state organs according to the economy level of its own and should be different from the applying conditions of affordabe hoursing and cheap renting housing,to resolve the housing promble of part the medium and low-income people who don't satisfy the conditions of the two housing security measures.In addition,in the view of the promble of the relevant legislation which has lagged behind,the thesis investigates foreign related system,sum up their experiences and learn how to improve our legal system on individual cooperation in housing construction.
