Circular economy is a sustainable development model of economic growth which takes resource efficiency and recycling as the core, "reduce, reuse and recycle "as the principle and the low consumption, low emissions, high efficiency as the characteristic. It is a fundamental change on the traditional growth pattern of "mass production, mass consumption, the large number of abundance". As a new mode of economic growth which makes the balance between economic growth, social development and environmental protection, circular economy needs legal recognition and protection to be fully realized.However, currently, the circular economy is still at the beginning stage in our country. There are obstacles in the way of developing circular economy. Practice proves that if these problems can't be effectively resolved, they will affect the development of the circular economy. To overcome these problems needs not only administrative and economic means, but also more importantly is to use legal means to resolve them. Legal means is more standardized, more stable, more mandatory, more openness and more authorized. It is the highest form by which the country controls the politics, economy and social development. Its role can not be replaced. So the circular economy legislation is necessary in the implementation of the "11th Five-Year Plan," development of a recycling economy, building a resource-saving and environment-friendly society and achieving sustainable economic and social developmentDeveloped countries, after long practice, are at the stage of the legal system with the forming of specialized and relatively sound legal promotion and protection of their own recycling - oriented society. There is two legislation mode in developed countries currently: one type is pollution prevention, such as the United States, Canada and other countries, and clean production in the prevention of pollution of the legal framework which belongs to the environmental law. Another is circular economy with Germany as the pioneer. Japan does perfect.This paper explains the basic theory of circular economy, the present situation and problems of China's circular economy legislation. It proposes the basic frame of China's circular economy legislation on the base of the full analysis of the developed capitalist countries' circular economy legislation experience.
