An Investigation Of The Legislation On The Integrated Transport Planning In China

Under the sustainable development strategy's instruction, integrated transport planning receives more attentions, and develops rapidly. The integrated transport planning law impacts on the role of integrated transport planning. In this paper, we study the problems of Chinese integrated transport planning. We study how to build the legal framework of Chinese integrated transport planning. This research aims at finding the way to be better.The first part of the article introduces the value and methods of research.Integrated transport planning is a new word to most people. In the second part of the article, we define the word integrated transport planning firstly (concept, characteristics) as an introduction and the foundation of research. We define and analysis the basic issues of integrated transport planning law.In the third part of the article we analyze the situation and problems of Chinese integrated transport planning. The main questions of integrated transport planning lie in the imperfect plan main body, plan revising system, the public participates system. This article holds that Chinese integrated transport planning law has not yet formed. That is why Chinese integrated transport planning has so many problems. So we must strengthen integrated transport planning legislation.In the fourth part of the article we introduce oversea's legal research on integrated transport planning. The oversea's legal research of integrated transport planning is comparatively more perfect. They basically formed a relatively complete legal system for integrated transport. This provides a reference for China to solve this problem. This article mainly refers to American, British and Germany's legislation experience. We can refer to their experience in order to consummate the relative system of our states.In the fifth part of the article we focus on how to build Chinese integrated transport planning legal system. We mainly refer to the legislative practice and experience of U.S, Britain and Germany. We explore ways to build our country's integrated transport planning laws by contrast. We believes that in order to build Chinese integrated transport planning law we must establish the following the legal system: an integrated transport planning legislative purpose, principles of law, approval of the principal, legal relations, legal responsibility, supervision and inspection in the legal system.This paper do research mainly though comparison method and histrionic method to analysis. This paper analyzes the present situation of integrated transport planning, learns from the advanced experience of foreign countries, and gives a suggestion to resolve exist questions. Do my best to make some break in the academic of integrated transport planning.
