The rural left-behind children refer to the children whose presents have gone out to work. With the increasing of the scale of left-behind children in rural areas, the infringement of their rights has become increasingly prominent. Damages to the interests of left-behind children in rural areas are as following: the right to be taken care of is damaged, such as the decline in quality of life, the Increase of labor burden; the threat to the right to life and health, such as the lack of medical protection, with no one to take care of the diseased and personal vulnerability; the right to education is hard to secured, such as the increasing of dropout rates, the decline in academic performance and the instability of living and learning environment; the threat to the right to life and health, such as the easy forming of psychological and personality obstacles, easy moral loss; right to participate being overlooked, such as the easy ignorence of their family and social views.The ineffective protection of the rights of children in rural areas dues to various reasons, including many factors such as family, school, society and government. The concrete manifestation are: the weaken family care, including single-parent custody, guardianship and Deputy peer monitoring; the deficiencent school supervision, such as poor hardware facilities, inadequate teacher staff; the misplaced social protection, such as the lost of the protection system in community; the lack of government securities.It is imperative to protect the rights of the rural left-behind children from the legislative, law enforcement and judicial measures. Specific measures include: the legislative protection, such as the construction of the legal system of the protection of the rights of children in rural areas, the development of"the law of the custody of left-behind children"; the law enforcement protection, such as the gradual reform of the household registration system, vigorously development of the rural economy and the increasement of the income of peasants, setting up a "rear children" Commission, the establishment of dynamic network protection, public security and judicial departments to strengthen law enforcement efforts; judicial protection, such as the establishment of judicial proceedings from the rear children proxy system, rear children in the rural areas to special juvenile justice system..
