Systematic Research On Intellectual Property Protection

The world has already entered the knowledge-based times,the whole world and especially the economic growth way of the industrialized country has taken fundamental change,the knowledge was playing a more and more important and even decisive role in the economic growth.The knowledge will become the most important element of production,which plays a more and more dominant status in the economic development.The knowledge economy is an intangible asset investment economy primarily in which based on the intelligence achievements including knowledge,information and so on.The establishment of knowledge economy relies on the intellectual property protection,the normal operation for the knowledge economy relies on the intellectual property protection and the development of the knowledge economy relies on the intellectual property protection.The intellectual property is the bridge which transform knowledge,science and technology into property and productivity,and it is the foundation of the knowledge economy realizes the property to an intangible investment.The intellectual property will occupy the important status in the process of transforming knowledge,science and technology into property and productivity.The good protection of the intellectual property from laws finally decided the exertion of the powerful engine function of the knowledge economy. Since the reform and open policy put in force,our country has established the more complete intellectual property system and obtained the achievement which attracts worldwide attention in 30 year,but our country intellectual property protection also has shortage in the integrity and the systematic characteristic.In this article,the author from the system theory attempts to narrate our country intellectual property protection,regards the intellectual property protection of our country as an open system which make the unceasingly exchange of materials,energies and information with the external environment,regards the self- perfection of the intellectual property protection as the self-organization of this system,regards the influence of China joining into WTO,specially the TRIPS agreement as "the negative entropy flow" of the intellectual property protection,which elaborated how are the system of our country intellectual property protection through the internal perfection and the external influence of"the negative entropy flow" become more reasonable and practical.This article divides into four chapters: The 1st chapter mainly discussed the concept of the intellectual property,the significance of the intellectual property protection,the concept of system theory and the relationship between the intellectual property and the system theory.The 2st chapter on the systematic analysis of intellectual property,and pointed out the shortage of our country intellectual property protection in the integrity and the systematic characteristic,introduced the experience of the partial national.The 3nd chapter from the system theory mainly analyzed "the negative entropy flow" in our country intellectual property protection system,elaborated that our country should insist the principle of the localization and the national interest when China join into WTO,and how to perfect our country's laws and cause it better connection with the TRIPS agreement following the above principle.The 4rd chapter from the system theory mainly analyzed the self-organization theory in our country intellectual property protection system,and united the internal cause of our country intellectual property protection to elaborated how to perfect our country intellectual property protection under the self- organization theory of the intellectual property protection,put forward the corresponding views for perfecting the management service system of the intellectual property protection,constituting the national strategy system of the intellectual property protection,constituting a unified intellectual property code and establishing and developing the trust service system of the intellectual property.
