Philosophical Reflections On The Right Protection Of Disadvantaged Group People In Transition

"Disadvantaged group people in transition" refers to the group people who are put at a disadvantage in the social, economic and political life and experience increasingly marginalization due to the social regrouping concerning rights and duties in the period of reform and open-up. In the modern society, Marxist view of being free and human right , the ultimate goal of which is human freedom and overall development, becomes the moral and legal basis for their right demanding. Those people have the rights to existence and development and of being employed, political participation and education. The limitation of their interest expression of those people at present brings about the direct way of letter appeal and appealing to the higher authority for help and indirect ways through congresses, trade unions at all levels and medias. The judicial proceeding is the basic means of seeking protection in the legal society which more and more people like to use it. More and more vulnerable people like to use the judicial proceeding as the basic means of seeking protection in the legal society.The issue of disadvantaged group people is the people's internal issue so that a system of right appeal and protection shall be set up in harmony society establishment. The public and pubic organizations should give not only concern, respect but also supports of human resource, finance and materials. Governments at all levels should provide fairness for household registration, employment, social security and income distribution. The legislative bodies and organs with legislature should have fairness of their legal rights. The judicial organs should conduct strict law-enforcement procedures. Finally the disadvantaged group people should develop self-reliance and legally organize themselves to have collective strength to protect their own rights.
