Discrimination in employment is widespread, and increasingly serious in China. The harm has become invisible. There is a lot of theory and practice of solving the problem in many Western countries but that how to understand and solve the problem of discrimination in employment is a topic in our country .In this paper, the method of empirical analysis and comparative study is used in solving those issues: defining discrimination in employment, China's current situation and characteristics of discrimination in employment, elimination and prohibition of discrimination in employment and others. This paper describes in our country the need to prohibit discrimination in employment. After that, in the present, the government should play a leading role in solving the problem of employment discrimination. The measures to prohibit discrimination in employment are necessarily based on China's market economy development level, awareness of the rights of citizens, and the judicial system. The better way in anti-discrimination in employment is improving the system, making use of existing organization and especially, opposing blindly copying Western law.
