Study On The Legilation For The Rural Minimal Livelihood Guarantee System

Today, the minimal livelihood guarantee in the rural areas has covered the whole country, but the legal system hasn't met the need. In order to realize the minimal livelihood, maintain and expand it, a further research on the minimal livelihood system in the rural areas is needed, which is a necessity for implementing the outlook of the scientific development and constructing harmonious society. In short, it is not only profound for reform and three agricultural issues, but also profound for social security system.From the concept of the lower living security in the rural areas, the thesis gives a description of the features and natures, and narrates the necessity and the possibility of the minimal living security system. Based on the situation and the problems on the legislation and practice of the lower living security in the rural areas, some ideas are provided: Firstly, the principle of rights to live, the principle of the state's duty, the principle of equality, the principle of encouraging self-dependence, the principle of combining fair and efficiency should be maintained. Secondly, some material advice on assurance target, assurance standard, the choice of assurance species and the assurance method, the source and management of assurance fund, the family budget investigation, the supervision and exit system, the legal liability are given. Thirdly, the uniform Law of Lower living Security should be draw up to give up the dualistic structure of the city and countryside, to ensure the realization of the equality of the city and countryside.
