Study On The Legislation For China's Rural Social Security System

Contemporary China is to build the harmonious society with scientific development concept, rural development is the important part of harmonious society, and the rural social security system is the problem must be solved in the development of Chinese rural. Chinese rural social security legal system remains imperfect, it is very important for China to improve rural social security legal system, it reflects the need for social justice, is to protect the basic human rights of the farmers needs and the needs of the building of the rule of law. This paper is divided into six chapters to analyze the building and perfection of Chinese rural social security legal system. Chapter one is the main introduction, including study purpose, Significance and method; Chapter two, historical review and present analysis of rural socially security. This part defines rural social security, looks back the history of social security and introduces its present situation and existed problems. Analyze the legal significance of the system, focusing on the basic human rights of peasants, social justice and the rule of law. Chapter three, study abroad rural social security, introduces the legal system of social security in the mainly western developed countries and Singapore and some developing countries. Chapter four, analyze several important problems needed to be solved, especially the liquidity problem of migrant workers. It is a complex systematic project for establishing legal system of rural socially security, we should cope with these problems well. Chapter five, analyze details of our country's rural social security legal system, focused on research medical, pension and the minimum livelihood guarantee system. These analyses with combination the latest development of the rural areas, put forward some new ideas on development, and pay some attention in some new problems in the construction of the concrete in the legal system. This paper take a major qualitative analysis and quantitative, analysis of empirical analysis and normative analysis. The integration of research methods, both theoretical analysis, are empirical data proved, and with the development of China's rural society of the new situation and new problems, and do better in studying theory with practice, this paper has a certain timeliness and innovation, it is hoped to benefit Chinese rural social security legal system.
