The formation mode of economic law is the logic basis of evolution, innovation and creation of economic law and its theoretical system. However, traditional understanding and construction of it is of a little simplicity and westernization, which affects the innovation of the system of the modern economic law sector. Taking our country's current construction of a new socialist countryside as specimens, this paper points out that, in the course of the change and restructure of the traditional agricultural order, which is just at the period of social transition, economic law beyond its traditional evolutionary mode, builds a new socialist countryside that other traditional sectors of the legal system are unable to supply. By the aid of the specimens, this paper reflects on economic law in mainstream mode of the China's tradition, and puts forward some of the views on the construction of the new evolutionary mode of economic law in transitional period.The paper comprises four main parts:The first part discusses the emergence of a new socialist countryside and its objective meaning, and points out that as inheritance and replacement of a traditional rural areas, the new socialist rural areas reflects in the quality of succession and that alternative itself is a specific aspect of the general features of social internal transformation. However, as the inheritance and sublation of a specific spatial location that is focused on the rural, which occurred during the changes of the social movements and production and lifestyle under the rural specific space-time-new rural construction has its unique characteristics, and a new socialist countryside containing the special objective meaning is precisely embedded in China's general social transformation.The second part, from the perspective of the rule of law, investigates the needs and reliance on the legal system to build a new socialist countryside, the limitation of the traditional sectors of law to build the new rural under the ample supply of law, in contrast with the extensive function of economic law in the course of building the rural areas, and implies that the modern economic law removing the weakness of the traditional sectors is the major supply station of law during the transition period of building a new socialist countryside.The third part takes the traditional mainstream mode of the evolution of China's economic law as starting point through the process analysis of providing law in the new socialist countryside construction. It sufficiently shows: the economic law transcending its traditional patterns offers the best supply of law for the new socialist countryside construction, as obviously diverges from the traditional evolutionary mode. It is worthy reflection under the background of the new socialist countryside construction due to the one-sidedness, the oneness and defects of the western theory in the traditional evolutionary mainstream-mode of China's economic law.Part IV focuses on the real blueprint of China's social transformation and its contemporization or superimposed time feature faced by the economic law. The paper puts forward the relevant proposals and ideas to construct the flexible system of the evolutionary mode of the transitional China's economic law in the interest of the new socialist countryside construction, building a new socialist countryside specimens of this window for example, the transition of Chinese economic law construction of model flexibility to.
