The Investigation Report On Water Administrative Enforcement In The City Of Benxi In Liaoning Province

Water administrative enforcement is one of the important means to implement the state water laws and regulations, it is of great significance for the maintenance of normal water order, the protection of water, water areas and water works, the development of the socialist economic construction and improving the people's material and cultural life. Data shows that, at present, there still exists a large number of issues of water administrative enforcement, such as weak and illegal law enforcement. In order to understand the issues of water administrative enforcement, the author conducted an investigation on the water law enforcement agencies in the city of Benxi in Liaoning province in the aspect of construction of agencies and fulfillment of the responsibilities .It aims to discover the problems and deficiencies of water administrative enforcement by the data analysis and put forwards some suggestions and the countermeasures to solve these problems .And finally it aims to give some guidance to the further improvement of water administrative enforcement in the city of Benxi as well as the other areas.This paper is divided into four parts. The first part, the outline of water administrative enforcement, gives a brief introduction of the concept, features and the content of the water administrative enforcement.The second part reports the result of the survey in the aspect of construction of agencies and fulfillment of the responsibilities. As for the aspect of construction of agencies, this part reports the result of survey on the law enforcement institutions and law enforcement officials. As for the aspect of fulfillment of the responsibilities, this part reports the result of survey on water monitoring and inspections, the water legal system propaganda and the investigation of illegal case.The third part, the main problems and the deficiencies, put forwards the major problems and deficiencies of water administrative enforcement in the city of Benxi through the investigation. In the aspect of construction of agencies, there exist the problems, such as the error of the law enforcement agencies positioning, insecurity of the source of funds, not high quality of the law enforcement officials and too many part-time law enforcement officials. In the aspect of fulfillment of the responsibilities, there exist the problems, such as the neglecting of the inspections, the mere formality of publicity on water laws, the imperfect of the law enforcement basis, interference by the executive in the course of law enforcement and poor water procedures awareness of law enforcement officials.The forth part is suggestions and countermeasures. This part is divided into two parts; one is the suggestions to construction of agencies, of which the author discusses in the aspect of the agencies and officials. The other one is the suggestions to fulfillment of the responsibilities, of which the author discuss in the aspect of the construction of water legal system, publicity and supervision to the water administrative enforcement.
